Our client was charged with a DUI 1st offense, KRS 189A.010. The client maintained from the beginning he was not under the influence and had not been drinking despite the officer’s allegations. The client performed the field sobriety tests that were recorded by the officer’s body camera. Once the client was arrested, he was taken to the jail for booking and asked to submit to an Intoxilyzer breath test. He refused the breath test. After negotiations with the prosecutor were unsuccessful, Tucker Richardson took the case to a jury trial.
After a full day of trial, the jury returned a verdict of “NOT GUILTY“. Our client walked out of the courtroom with his head held high knowing the justice system worked.
