Our client was charged with DUI, after she was involved in a collision and called the police herself. An experienced officer and a trainee were dispatched to the scene. Our client was put through field sobriety tests and then arrested for DUI.
The attorney thoroughly reviewed the police officers’ body worn cameras, which revealed that the experienced officer interacted with the client and even trusted and advised her to get behind the wheel of her car to determine if it was still operable. He directed that if the car was drivable, our client would be able to leave momentarily, and if there were problems, she could pull over and request a tow truck. The trainee officer spoke with the experienced officer and is observed passing a note to the experienced officer. Thereafter, is when the client is then subjected to a series of field sobriety tests and then placed under arrest for DUI. Our attorney pointed out these evidentiary issues to the prosecutor and how that would appear in front of a jury, if taken to trial. The prosecutor then agreed to amend the charge to careless driving. Our client avoided a DUI conviction being on her record for the next 10 years.
